Timeline — What Actually Happens

Most of the wait is not you and it is not us. It is the State Controller’s review, and it is measured in months.

Last reviewed Written from State Controller, State Controller data Everything here is checkable without asking us.

The Stages, and Roughly How Long Each Takes

Stage Who holds it Typical
Search and identification You or us Same day
Written disclosure and agreement Us, then you 1–7 days
Assembling documents You 3–30 days
Review and preparation Us 2–5 days
Notarization Us 1–10 days
Filing with the Controller Us 1 day
State review The Controller Several months
Approval and payment The Controller Weeks after approval

There Is No Deadline

California does not impose a time limit on claiming unclaimed property. Nothing expires while you gather documents. If anyone suggests otherwise, that is a pressure tactic, not a fact.

What Makes a Claim Slow

Almost always documents. A missing address proof, an uncertified death certificate, or a gap in the chain of names sends the file back and restarts the clock. Getting the packet right the first time is worth more than any amount of chasing afterwards.

How Long This Actually Takes

The honest answer is that it depends almost entirely on what kind of property it is and who is claiming, and that most of the waiting belongs to the State rather than to you.

Kind of claim Typical time once the file is complete
Simple cash, owner claiming, filed electronically Around 10 days
Simple cash, owner claiming, standard filing 30 to 60 days
Securities Up to 180 days
Safe deposit box proceeds Up to 180 days
Heir or estate claims Up to 180 days, often the full period
Business claims Up to 180 days

The Controller is required by law to consider any complete claim within a hundred and eighty days of receiving it. That clock starts when the package is complete — which is why the weeks spent gathering documents are not wasted time, they are the time that decides everything after.

The Stages, and Who Is Holding Things Up

Searching and Identifying — Days

Finding the property and establishing that it plausibly belongs to you. Quick, and entirely ours.

Gathering Documents — Days to Months

This is the part you control, and the part that most often runs long. An old address that nobody can evidence, a death certificate that has to be ordered from a county recorder, siblings who need to agree — any of these turns a fortnight into a season.

Preparation and Notarization — Days

Assembling the package the way the Controller wants it, and notarizing the affirmation where the rules require it.

State Review — Weeks to Six Months

The long part. The Controller checks entitlement, matches the record, and either approves, asks for more, or denies. Nothing you do speeds this up, and no one who tells you otherwise is being straight with you.

Payment — Weeks

The Controller pays the claimant directly. Securities take longer than cash, because shares may have to be sold or transferred before anything is issued.

What Makes It Slower

  • An address on the record that nobody living can evidence
  • More than one person entitled, and no agreement between them
  • Securities, which involve a transfer agent as well as the Controller
  • A business that dissolved without a clear successor
  • Documents sent back once for legibility, which restarts the review

What Makes It Faster

  • Sending everything at once rather than in instalments
  • Ordering certified death certificates before you think you need them
  • Settling among heirs in writing at the start
  • Photographing documents properly the first time

There Is No Deadline

California holds unclaimed property indefinitely. It does not expire, it is not forfeited, and waiting a year costs you nothing but the year. Anyone creating urgency about a filing window is selling, not informing.

How You Are Protected

Our fee is capped at ten per cent of what is recovered by Code of Civil Procedure §1582, and nothing is owed until the State Controller has paid you. If we recover nothing, you owe nothing. Our recovery fee is never asked for up front — it comes out of money the Controller has already paid you. A booking deposit on an in-person appointment is a separate thing, and is credited back against anything you are charged.
